ALBATROSS TOURS BOOKING CONDITIONS
- All prices are in $AUD (or $NZD if you are based in New Zealand and accessed on our albatrosstours.co.nz website) unless stated otherwise and are for cash/cheque payments. Credit card payments attract a service fee.
- Deposits represent a booking fee and are non-refundable.
- A non-refundable deposit of 10% of the invoice value, which is the retail price less any applicable discounts, per tour, is required within 7 days to secure your booking.*
- Full payment is required 90 days prior to travel.
Date changes – Bookings may be transferred to an alternative tour departure within the same season departure, without charge and subject to availability, up until 90 days prior to the departure date.
SPECIAL TO OBERAMMERGAU TOURS 2022
A $1700 per person deposit is required to secure your space on tour. Once received and applied it is non-refundable and can only be transferred (up and until 90 days prior to departure), subject to availability, to an alternative 2022 Oberammergau Passion Play Tour.
TRAVELLER INFORMATION FORM
CANCELLATION POLICY - ALL TOURS
- If cancelled prior to the full payment due date a cancellation fee of the deposit applies.
- If cancelled after the final payment due date but more than 45 days before travel a cancellation fee of 50% applies.
- If cancelled less than 45 days prior to travel, a cancellation fee of 100% applies.
You agree that these cancellation charges are reasonable, represent a genuine pre-estimate of our loss and are required to protect our legitimate business interests. For group departures, a transfer of a confirmed booking to another departure date is deemed to be cancellation of the original booking.
*For bookings where a travel credit is being redeemed, please refer to the REDEMPTION OF TRAVEL CREDITS section for the applicable cancelation policy.
CANCELLATION BY US
If we, acting reasonably, determine that your tour cannot proceed due to flood, earthquake, war or civil strife, acts of terrorism, hurricane, cyclone, industrial disturbance, strike, fire, lock out, epidemic, pandemic (including without limitation of Covid-19), failure or delays of scheduled transportation facilities, or other Acts of God, or any law, order, decree, rule or regulation of any government authority (including without limitation restrictions on international travel), or for any reason whether of a similar or dissimilar nature beyond the control of Albatross (Force Majeure), we may at our election:
- Postpone your tour, in which case we will issue you with a credit note equal to amounts paid at the time of postponement less any third party supplier costs we have incurred or committed to incur that are unrecoverable; or
- Cancel your travel arrangements, in which case our contract with you will terminate.
We may make a determination to postpone your tour or cancel your travel arrangements up to but not more than three (3) months prior to your tour’s scheduled commencement.
If we cancel your travel arrangements and our contract terminates, neither of us will have any claim for damages against the other. However, we will refund you any payments you have made less any third party supplier costs we have incurred or committed to incur that are unrecoverable, and less fair compensation for work we have undertaken (and associated overheads) developing your tour and servicing your booking as reasonably determined by us.
If we have incurred any third party supplier costs, then we will use reasonable endeavours to recover those amounts. We do not promise that we will be able to recover any supplier costs. We will pay any recovered amounts to you within a reasonable time of us receiving them.
If we issue you with a credit note, then it will be redeemable within 12 months after we issue it, for travel on a future Albatross operated tour commencing no later than 12 months following the date of redemption. Credit notes are not redeemable for cash but are transferrable to family and friends.
If we provide you with any alternative services or assistance where your tour is cancelled because of Force Majeure, then you agree the amount to be refunded or credited to you will be reduced by the value of these services and assistance.
If we cancel your tour for reasons beyond Force Majeure, you will be offered (at your election) a full refund of all funds paid over to us, or the offer of a trip of substantially equal or better quality if appropriate.
Albatross disclaims any liability to you for the costs of airfares, visas or any other expenses incurred by you as a result of postponement or cancellation of your tour by us whether due to Force Majeure or otherwise.
REDEMPTION OF TRAVEL CREDITS
If you redeem your travel credit held with us, then your credit will be applied to your new confirmed booking. In the event the tour against which your travel credit has been redeemed is unable to operate, due to government travel restrictions or regulations or other Force Majeure event, your payment will automatically revert to a full travel credit with Albatross Tours, at no charge to you, to be redeemed against future travel. You will not be entitled to any cash refund.
Should you wish to cancel your booking, against which you have applied your travel credit, cancellation fees will apply. Cancellation fees will be determined by the value of the travel credit less any unrecoverable costs associated to your original booking.
All cancellations must be received in writing. Because we incur costs and provide services for each instance where we confirm your booking, or confirm a revised booking, the following cancellation charges will be payable:
• If cancelled prior to the full payment due date a cancellation fee of the deposit applies.
• If cancelled after the final payment due date but more than 45 days before travel a cancellation fee of 50% applies.
• If cancelled less than 45 days prior to travel, a cancellation fee of 100% applies.
Please note in addition to the above cancellation fees, if you choose to cancel more than 45 days before travel and have redeemed your travel credit to your booking, you will be charged unrecoverable costs associated to your original booking.
By accepting this booking conditions, you agree that these cancellation charges are reasonable, represent a genuine pre-estimate of our loss in order protect our legitimate business interests.
ILLNESS PREVENTING TOUR COMMENCEMENT OR CONTINUATION
If due to any illness, suspected illness, or failure to satisfy any required tests (such as a temperature test):
- An airline or other common carrier refuses you carriage;
- A hotel refuses to accommodate you; or
- Albatross (acting reasonably) excludes you from the tour
and you are consequently prevented from commencing or continuing your tour, then if you have already commenced your tour, we will provide you with reasonable assistance to arrange alternative travel arrangements or to re-join the tour. This will be at your cost. If you have not commenced your tour, then we regret we will not be in a position to provide such assistance.
You acknowledge that if you are prevented from commencing or continuing your tour in these circumstances:
- Albatross will not be liable to refund the cost of your tour (or any part of it) because we would have already paid (or committed to pay) suppliers and we would have already performed significant work preparing for the delivery of your tour and servicing your booking; and
- Albatross disclaims any liability to you for the costs of airfares, visas or any other expenses incurred by you as a result of you being prevented from commencing or continuing your tour in these circumstances.
It is a condition of travel that each passenger is adequately covered by comprehensive travel insurance for the duration of your tour with us. Your travel insurance policy must provide adequate cover for participation in all included activities as part of the tour. Please check the details within your product disclosure statement and ensure you are aware of its conditions and omissions.
GUARANTEED GROUP DEPARTURES
All tour departure dates offered by Albatross Tours in this brochure are based on group touring programmes. The term ‘group tour’ is defined as having a minimum of 10 passengers travelling. Once Albatross Tours, confirms 10 deposited passengers travelling, it guarantees that the group tour will depart (subject to any cancellation due to a Force Majeure Event). In the event of only 9 passengers or less booking and travelling on that specific departure we reserve the right not to operate that departure as a group tour, that departure may be withdrawn, and your booking cancelled. Albatross will endeavour to advise all parties concerned of the withdrawal of the tour at least 90 days prior to its scheduled departure date. In this circumstance, we will refund all amounts you have paid, but we will not be responsible for any loss or expenses you incur due to the cancellation, including, without limitation, any lost airfares or the costs of alternative travel arrangements.
In the unlikely instance that more than 33% of the number of deposited passengers on any declared Guaranteed Departure choose to cancel and not travel for whatever reason, and the number of remaining passengers travelling on that Group departure drops to 9 passengers or less, Albatross reserves the right to withdraw any previous Guarantees of Departure. This withdrawal may occur up to 60 days prior to the scheduled departure date.
Wherever possible, price increases will be absorbed by Albatross Tours. In the event of a reduction in the numbers of passengers travelling on any specific group tour; or tax, or other supplier price increases beyond our control, including the result of negative exchange rate fluctuations, Albatross Tours reserves the right to pass on these increases in costs with or without warning to its passengers. Your tour price will become guaranteed 120 days prior to its departure date and will not then vary regardless of any later cost increases to us.
When group sizes are considered too small to use a full-sized touring coach we reserve the right to use a smaller coach. Smaller coaches and any vehicles used for local transfers and occasional day excursions may not have toilet facilities on board. WiFi on coaches is usually available but cannot always be guaranteed. Individual country and EEC laws regarding coach transportation will be abided by at all times.
CHRISTMAS PROGRAMME - TRANSFERS BETWEEN TOURS
Intercity Group transfers, by coach or train, linking selected Christmas and New Year tours are subject to minimum numbers. Should the number of passengers travelling on any Group transfer be less than 10 then we reserve a right to charge a transfer fee, or withdraw the transfer.
We contract double rooms for sole use for guests paying the solo traveller price. Whilst we contract the same standard of room for all guests, it is at the discretion of the hotel as to the allocation of rooms. Due to the unique nature of our contracted hotels, allocated rooms may vary between guests and Solo Travellers may receive a smaller sized double room or in some cases a twin-bedded room. The Solo Traveller price reflects fees and charges passed on to us by our suppliers.
TWIN & TRIPLE SHARE ROOMS
Throughout much of central Europe traditional hotels sometimes offer ‘French Twin’ sleeping arrangements which comprises of two separate single beds and mattresses attached together, often sharing a single headboard.
Many modern hotels now have glass-walled bathrooms, with or without privacy curtains. Please consider this when booking a twin share room. Triple rooms are available on request. If available, triple rooms may consist of one double or two single beds and the third bed may be a rollaway or sofa bed, which in many cases may not always be entirely suitable for an adult. Therefore, triple share rooms are only suitable when the third person is 14 years or younger. In most cases, the addition of a third bed will result in the space in the bedroom being limited.
Unless otherwise stated, hotel porterage for one suitcase per person is included at each stay during your tour. Porterage is not included on the first or last days of your tour when arriving or departing your hotel independently.
MINIMUM MOBILITY REQUIREMENTS
Albatross offers a range of tours to a variety of destinations. A number of tours include visits to hilltop towns, which may have some steep, uneven cobblestoned streets or castles, and attractions with steep staircases and no lifts. Additionally, some larger cities only provide coach passenger drop off points beyond the city-wall limits of old town centres. A reasonable amount of walking will be involved on all tours and therefore a certain level of fitness and mobility is required. If you have walking difficulties or mobility limitations our tours may not be suitable and we reserve the right not to accept your booking. For further information or clarification on minimum mobility requirements please refer to your brochure, the Albatross website or call our offices.
PASSPORTS AND VISAS
It is the responsibility of the passenger to hold a valid passport and arrange all necessary visas, permits and certificates required for your selected tour(s). You are required to provide your valid passport by the final payment due date. If those details are not advised by this date, then a $25 per person service fee will apply. If you are unsure about which visas you require, your travel agent will be able to advise you or please call our offices.
EXCLUSION FROM TOUR
We may exclude you from the tour at our discretion if you fail to comply with our (or any of our supplier’s) reasonable instructions (which may include personal hygiene directions consistent with generally issued medical guidance to reduce the incidence of infectious virus’ such as Covid-19), or if we (or our supplier) acting reasonably consider that you are interfering with the other travellers enjoyment of the tour, or if you require special assistance due to an existing medical condition or disability not previously disclosed to us. If we exclude you from the tour, then you will not be entitled to any refund for any remaining portion of the tour and you will be responsible for all costs associated with your onward travel.
No refund is given for any partially or wholly unused services/ tour inclusions. No overseas supplier or associate is authorised to promise a refund on behalf of Albatross Tours.
Every effort will be made to adhere to the published touring itinerary. Occasionally, circumstances beyond our control will force changes, amendments, or modifications to the itinerary and its inclusions. To the fullest extent permitted by law, Albatross Tours will not be responsible for any omissions or modifications to the itinerary or the inclusions made as a consequence of these circumstances. If you are entitled to any compensation at law for any changes or modifications in these circumstances, then you agree that any compensation you are entitled to will be reduced by the value of any alternative services we provide to you which you accept. We will not be responsible to you for any expenses or loss you incur in connection with your booking resulting from any amendment or change to the itinerary or its inclusions.
In the unlikely instance of a hotel change becoming necessary the alternative property will be of a comparable or higher standard and there shall be no refund in this connection. Non-smoking rooms may be requested however, they cannot be guaranteed as not all European hotels offer non-smoking rooms.
SPECIAL DIETARY REQUESTS
Special dietary requests are required to be notified to us at the time of booking. Although we will use reasonable endeavours to accommodate requests, we cannot guarantee requests will be met by suppliers. It is your responsibility to check that meals and beverages do not contain any allergens. We expressly disclaim any liability for meals or beverages that contain allergens.
We rely on the information provided in your Traveller Information form and as updated as necessary. You warrant that the information you provide is accurate and there are no other medical issues that may impact your ability to participate in the tour without the need for special assistance. We reserve the right to exclude you from a tour if we acting reasonably are of the opinion that you require special assistance for a condition not previously fully disclosed. If your circumstances change following completion of your Traveller Information form, then you must notify us as soon as reasonably possible, and in any circumstance prior to travel. We reserve the right to cancel your booking if your changed circumstances mean you will require special assistance from our personnel during the tour. We suggest that your travel insurance (which you are obliged to have in place under these Booking Conditions) includes comprehensive cancellation coverage.
We will not be liable for any damage, injury, death or loss of any kind arising from your failure to disclose relevant medical information.
We are not responsible for any additional activities or excursions which are not included in the booked itinerary or which we sell as agent for the principal operator. Any advice or recommendation made by a guide or local representative does not make us responsible.
WHITE CHRISTMAS TOURS – SNOW
A large part of Central Europe is normally covered by snow over Christmas time. Please note that weather conditions vary from year to year and snowfalls cannot be guaranteed.
NORTHERN LIGHTS TOURS – Aurora Borealis
The Aurora Borealis (‘Northern Lights’) are a natural phenomenon and reliant on nature and clear skies. We will be staying in the North of Scandinavia and Iceland at some of the very best Aurora spotting locations. The chances of catching a wonderful display are very high however, cannot be guaranteed.
NOT INCLUDED IN THE TOUR PRICE
Unless otherwise stated, flights, visas, airport taxes, port taxes, city taxes, security charges, airport transfers, items of a personal nature, laundry, additional beverages and consumables are not included in the tour price.
In the event of a problem with any aspect of your tour you are obliged to make an Albatross Tours representative or our local supplier aware of such problems immediately. Albatross Tours offers a 24-hour emergency contact phone number for this purpose.
In the event of dissatisfaction with your hotel room, please advise the hotel and/or your tour manager immediately so they may try to rectify the situation if possible.
Albatross Tours will only consider claims made against it in those circumstances where we or our suppliers have had the opportunity to put things right and where the claim has been received by us, in writing, within 30 days from the end of the services provided by us, otherwise, the client will have no right to make any claim against us.
Albatross Tours makes every effort to ensure the quality of accommodation and the accuracy of information in our brochures and on our website, but shall not be liable for any dissatisfaction the passenger may have with the accommodation and touring or any injury, damage or loss caused by the change or withdrawal of any price, detail or other item or service.
RESPONSIBILITY & LIABILITY
Acceptance of risk
You acknowledge that travel involves personal risks which may be greater than those present in your everyday life. This could be as a result of the adventurous nature of your trip or the visiting of destinations which present geographical, political or cultural risks and dangers.
You should consult guidance issued by the Department of Foreign Affairs and Trade (DFAT) applicable to the destinations within your itinerary. You acknowledge that your choice to travel is made having had the benefit of DFAT guidance, and you accept any additional personal risks associated with your travel. To the fullest extent permitted by law, we disclaim any liability for these risks.
Services supplied by independent suppliers
Where a third party over whom we have no direct control (Independent Suppliers) is the supplier of travel arrangements that form part of your tour, you acknowledge that our obligations to you are limited to arranging for the Independent Supplier to provide those travel arrangements to you. Independent Suppliers over whom we have no direct control include airlines, railway and cruise operators, hoteliers and common carriers. We act as an intermediary only and you will be subject to the terms and conditions of the Independent Supplier (copies available upon request).
To the fullest extent permitted by law, Albatross Tours will not be responsible to you for any loss, damage, personal injury or delay attributable to the actions or omissions of an Independent Supplier.
Services we supply as principal
To the extent only that we are the principal supplier of travel arrangements or other services to you which we control, then we will provide those travel arrangements and services with reasonable skill and care. We will only be responsible for our employees in the course of their employment, and for our agents and suppliers (where we are not the supplier’s agent or an intermediary for an Independent Supplier) if they were carrying out the work we had asked them to do.
We will not be responsible for any loss, damage, claim or expense caused by the acts or omissions of yourself, of any other third party not connected with the provision of the travel arrangements or services, or due to an event of Force Majeure.
Please note that if the travel arrangements or services which gave rise to the claim complied with local laws and regulations, the travel arrangements and services will be deemed to have been properly performed, even if this would not be considered the case in Australia.
General liability limitation
We will not be responsible if the loss, damage, claim or expense was caused by the acts or omissions of yourself, of any other third party not connected with the provision of your holiday arrangements, or due to an event of Force Majeure.
Australian Consumer Law and corresponding or equivalent legislation in other jurisdictions (including if you are a resident of New Zealand, any consumer law which is in effect in New Zealand and which applies to our contract with you) in certain circumstances imply mandatory conditions and warranties into consumer contracts (“Consumer Warranties”). These Booking Conditions do not exclude or limit the application of the Consumer Warranties. Other than the Consumer Warranties, Albatross Tours disclaims all warranties.
To the fullest extent permitted by law, the maximum liability of Albatross Tours to you under these Booking Conditions, in tort (including negligence) or at law is limited to arranging for the travel arrangements to be resupplied or payment of the cost of having the travel arrangements resupplied.
This agreement shall be governed and controlled in accordance with the laws of Queensland, Australia. If any provision of these conditions is found to be unenforceable, then it will be severed from these conditions without affecting the remaining provisions.
If you place a booking on behalf of another party, you represent and warrant us that you are duly authorised to provide the agreement and consent of the other party to be bound by these Booking Conditions. You agree that you will be responsible for any loss or damage we incur if this is not the case.
